This Privacy Policy (the “Privacy Policy” or “Policy”) is intended to describe the types of information that SCIENJOY META TECHNOLOGY L.L.C and its affiliates (“SoulChat AI,” “we,” “us,” or “our”) collect and process about you.

Except as described below, this Policy applies to all websites, mobile applications, and any other electronic/digital products or other services offered by SoulChat AI that link to this Policy, as well as our offline services (collectively, the “Services”).

Capitalized terms that are not defined in this Policy have the meaning given to them in the SoulChat AI Terms of Service.

1. Information We Collect

We collect information from you when you visit or otherwise use our Services. The types of information we collect depend on how you use our Services. Please note that we need certain types of information to provide the Services to you. If you do not provide us with such information, or if you ask us to delete it, you may no longer be able to access or use certain Services. The information we collect includes data you provide to us directly, data we obtain automatically through your interactions with our Services, and data we obtain from other sources.

Information You Provide Directly to Us. We collect information from you directly. For example, you provide information to us when you use the Services, communicate with us, register for an account, subscribe to our blogs or newsletters, or participate in our communities, social media discussions, or promotions. The information you provide to us directly may be about you and others and may include:

  • Identifiers, such as your name, email address, phone number, display name, or username;
  • Demographic information, such as your date of birth and approximate geographic location information;
  • Interest information, such as categories like “sports” or “writing”;
  • Inferred information, such as preferences based on account settings or feedback on the Services;
  • Financial information, such as payment information and other information collected through our payment processing vendors;
  • Commercial information, such as purchase records and transaction history;
  • Content you submit, such as chat communications, posted images or videos, bio descriptions, and shared avatars;
  • Voice data, including recordings of your voice if you choose to use certain voice-enabled features; and
  • Communications with us, such as customer support messages.

The information you provide to us directly may also contain information that may be considered sensitive under applicable law, such as login credentials, personal communications you receive or send using our Services, or other information you choose to provide about yourself when using our Services (for example, if you voluntarily include information in user-posted content that reveals your race, religion, or sexual orientation). The provision of sensitive personal information is not required or necessary to use the Services—please do not include any sensitive personal information in your interactions with us or the Services.

Information We Collect About Your Use of the Services. We and our third-party providers, including advertising and analytics providers and other service providers, use cookies, web beacons, and other tracking technologies to collect information about your use of the Services. Please note that the specific tracking technologies and third-party providers may vary depending on your geographic location and whether you are accessing the Services through our website or mobile application. As further described in the Cookie Policy, we use these technologies to collect and analyze device, internet, and other electronic network activity information, including information about your computer or device (e.g., device type; browser type; ISP or operating system; IP address; device identifiers, such as IDFA, Android ID, etc.; the version of our Services you are using); information about how you use and interact with the Services (e.g., domain names; access times; source or exit pages; page views; identifiers associated with the Services, such as user IDs, chat IDs, session IDs, etc.; and actions taken within the Services); and geolocation data.

Information We Collect From Other Sources. We may also collect information from other sources, such as when you are referred to us by another user. In this case, we may receive your name and contact information. We may also receive information from third-party platforms, for example, when you interact with our ads on other platforms like YouTube, TikTok, or Reddit, or when you interact with our social media profiles on platforms like Facebook, Instagram, or Discord. The information we collect in these instances includes information about how you interact with our ads or the third-party platforms; information about your device; demographic information (e.g., age, interests); and geolocation data.

We also collect information when you use an account maintained by a third party, such as a social media account (“Third-Party Account”), to connect to your account. The Services will collect information about you from your Third-Party Account in accordance with your permissions. When you connect or log in to us through a Third-Party Account like Facebook or Google, we receive information from that third party that identifies your account. The information we collect in this case includes Third-Party Account details like your username or email address. We collect and store this information and use it to help you connect to the Services. Connecting your account to Third-Party Accounts is completely optional, and you will have the opportunity to grant permission when you attempt to connect. You can revoke permission by logging into the Third-Party Account and disconnecting SoulChat AI from there, as well as through the native application on your mobile device. Please note that if you revoke permission to a Third-Party Account, we may retain the information we previously collected from the Third-Party Account provider (but the account will no longer be linked in the future).

We also collect information that is available on the internet or from other publicly available sources to evaluate and improve our Services, including for model training and development.

2. How We Use the Information We Collect

We use information for the following purposes:

  • To provide, administer, and operate the Services and our business;
  • To generate and analyze inferences about the use of the Services, such as your preferences and interests, and trends regarding our Services (e.g., which parts of the Services are most frequently used, how users navigate the Services, and what our users like or dislike);
  • To customize the Services based on your preferences and interests;
  • To evaluate the success of advertising campaigns;
  • To communicate with you, including to inform you of features or aspects of the Services that we think you may be interested in;
  • To communicate with you regarding changes to our terms, conditions, or policies; or to respond to your inquiries, comments, feedback, or questions;
  • To analyze, maintain, improve, modify, customize, and measure the Services, including training our artificial intelligence/machine learning models;
  • To develop new features, algorithms, and machine learning models, programs, and services;
  • To provide advertising and recruit new users, including providing customized advertising;
  • To verify your account credentials so that you may log in to the Services and to help secure your account;
  • To process payments;
  • To detect and prevent fraud, criminal activity, or misuse of our Services, and to maintain the security of our IT systems, architecture, assets, customers, and networks; and
  • To comply with legal obligations and legal process and to protect our rights, privacy, safety, or property, and/or that of our affiliates, you, or other parties, including to enforce our Terms of Service and any other agreements or policies.

We combine the information we collect through the Services with information we obtain from other sources. We also may aggregate or de-identify the information we collect through the Services. We use aggregated or de-identified data for a variety of purposes, including for research and marketing purposes, without limitation. In circumstances where we have de-identified data that was initially based on personal information such that it can no longer reasonably be associated with an individual or household, we will maintain and use such data in a de-identified form and will not attempt to re-identify the data (except to confirm it has been de-identified).

3. When We Disclose the Information We Collect

We disclose information in any of the following circumstances:

  • Affiliates. We disclose information to our affiliates and subsidiaries, who may use the information we disclose in a manner consistent with this Policy.
  • Vendors and Service Providers. We disclose information to employees, consultants, service providers, and other vendors who need access to such information to carry out work on our behalf or to perform services, such as vendors that provide data storage, payment, technical support and services, customer service, analytics, fraud prevention, content moderation, legal services, and marketing and advertising services.
  • Security and Protection of SoulChat AI and Others. We may disclose certain information if we believe in good faith that it is necessary or appropriate to (i) protect or defend SoulChat AI or others, including to defend or enforce this Policy, our Terms of Service, our Community Guidelines, or other policies, or any other contractual arrangement; and/or (ii) protect the rights, property, or personal safety of SoulChat AI, our agents and affiliates, our employees, users, and/or the public.
  • Advertising and Analytics. We may disclose personal information to advertising and analytics providers to serve customized advertising, monitor the performance of advertisements we place on our behalf on the Services and across the internet, provide analytics services, and to help improve our Services. These entities may use cookies and tracking technologies so that we can, among other things, track and analyze data, determine the popularity of certain content, deliver customized advertisements and content, and better understand your online activity.   • Your Content. Certain actions you take may result in your content being made available to others, including the public. For example, if you create or share content, such as creating a “public” avatar or a “public” virtual voice, we may make that content available to and visible by others.
  • Legal Requirements. We may disclose certain information if we believe in good faith that it is necessary or appropriate to comply with any law enforcement, legal, or regulatory process, such as to respond to a search warrant, subpoena, court order, or other applicable law or regulation.
  • Business Transfers. We may disclose certain information in the course of, or during negotiations or consummation of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company.
  • Other Disclosures With Your Consent or at Your Direction. We may make additional disclosures of information to third parties when you direct us to do so. For example, when you refer us or our Services to your friends or other acquaintances, you direct us to disclose information about you.

4. Your Choices

We provide you with certain choices regarding the collection, use, and disclosure of your personal information.

  • Profile Information. You may delete your account through your account profile page. You may also verify, correct, update, or delete certain of your information through your account profile page.
  • Marketing Communications. You may unsubscribe by following the instructions in the marketing emails. Please note that if you unsubscribe from marketing emails, we may still send you administrative emails regarding the Services, for example, notices of updates to our Terms of Service or this Policy.
  • Cookies. Depending on where you reside and the options available on your device or browser, you may have the ability to manage the cookies being used. For more information, please see our Cookie Policy.
  • Rights Regarding Your Information. For more information on region-specific rights for residents of the European Economic Area, the United Kingdom, and the United States, please see our Regional Privacy Disclosures. Depending on where you live and subject to applicable exceptions provided by local law, you may have the following rights:
    • To request information about our processing of your personal information;
    • To request access to and/or a copy of certain information we hold about you (including in a portable and/or machine-readable format);
    • To object to our processing of your personal information;
    • To opt out of the sale of personal information or targeted advertising;
    • To update or correct your personal information;
    • To request that we delete certain personal information we hold about you;
    • To restrict the way we process certain of your personal information;
    • To request we transfer your information to a third-party service provider;
    • To withdraw consent to the processing of your personal information where you have previously provided consent under applicable law; and
    • The right not to be discriminated against for exercising your rights.

Please note that certain information may be exempt from such requests under applicable law. For example, we may retain certain information to comply with the law and to protect the security of our Services. We may need certain information in order to provide the Services to you; if you ask us to delete it, you may no longer be able to use the Services.

6. Children’s Privacy

The Services are not designed for minors under the age of 13, and our Terms of Service prohibit anyone under 13, or (if you are a resident of the European Economic Area or United Kingdom) under 16, from using them.

7. Data Retention

General. We will retain your information for as long as necessary for the purpose of processing, or as otherwise stated at the time of information collection, unless a shorter retention period is required by law. The length of time we retain information depends on the purposes for which we collected and use it and/or your choices, after which time we may delete and/or aggregate the information. We may also retain and use this information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

Popular Avatars. If you create an avatar that has been made available for other users to use, we reserve the right to retain the avatar’s characteristics and keep that avatar active on the Services even if you delete your data and your account. We do so to avoid impacting the experience of other users. To ensure that we do not retain information about you in this scenario, if you are creating an avatar you plan to make available for others to use, please avoid submitting any such information in the avatar creation flow.

8. Links to Third-Party Websites

The Services may contain links to third-party websites or services. We are not responsible for the content or practices of those websites or services. The collection, use, and disclosure of your information by third parties will be subject to the privacy policies of the third-party websites or services, and not this Policy. We urge you to read the privacy and security policies of these third parties before providing information to them.

9. Changes to this Policy

We may update this Policy from time to time. We will indicate the date of the most recent update within this Policy. If we make material changes to the Policy, we will provide you with appropriate notice in accordance with legal requirements, by email or by posting a prominent notice on our website or mobile application. Your continued use of the Services constitutes your acknowledgment that you have read and understood the most recent version of this Policy.
